1. Introduction

Welcome to Hiva (“Application”, “App”, “Service”). These Terms and Conditions (“Terms”) govern your use of the Hiva mobile application developed by Prem Sai (“Service Provider”, “we”, “us”, or “our”).

By downloading or using this App (via Apple App Store or Google Play Store), you agree to be bound by these Terms. If you do not agree, please uninstall and discontinue use immediately.

2. License and Usage

You are granted a non-exclusive, non-transferable, limited license to use the Application for personal and non-commercial purposes on any Apple-branded or Android device that you own or control.

  • You agree not to copy, modify, distribute, sell, or lease any part of the App or its included software.
  • You may not reverse-engineer, decompile, or extract the source code of the Application.

3. User Responsibilities

By using Hiva, you agree that:

  • You will use the Application lawfully and for intended purposes only.
  • You will not upload or share content that is unlawful, abusive, or infringes upon others’ rights.
  • You are solely responsible for any content (voice, text, images, visualisations, affirmations) you create or upload within the App.
  • You are at least 13 years of age, or you have parental/guardian consent to use the App.

4. Permissions and Access

The Application may request access to the following features of your device:

  • Camera: For capturing or uploading visuals for affirmations and personalisation.
  • Microphone: For recording voice affirmations and commands.
  • Storage: To save locally generated files (if applicable).
  • Network Access: To serve ads, analytics, and sync affirmations or visualisations.

These permissions are used solely for app functionality and are described in detail in our Privacy Policy. You can revoke permissions anytime in your device settings (e.g., iOS Settings > Privacy).

5. In-App Advertising and Third-Party Services

The App may display advertisements served by AdMob and may use Google Play Services or other analytics tools. Third-party services have their own Terms and Privacy Policies. By using Hiva, you also agree to comply with those third-party terms as applicable.

6. Intellectual Property

All content, features, and functionality within Hiva (including text, graphics, logos, AI visualisation outputs, and design) are the intellectual property of the Service Provider. You may not reuse, distribute, or reproduce any part of the App content without explicit written permission.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service Provider is not liable for any direct or indirect damages, including loss of data, emotional distress, or loss of profits, arising from your use of the Application.
  • The Application is provided “AS IS” and “AS AVAILABLE”, without any warranties of performance, reliability, or fitness for a particular purpose.

8. Termination

We may suspend or terminate access to the Application at any time, without prior notice or liability, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately.

9. Updates and Modifications

The Application may be updated automatically or manually. We reserve the right to modify or discontinue any part of the App or these Terms at any time. You are responsible for reviewing these Terms periodically for changes. Continued use after changes constitutes your acceptance.

10. Privacy and Data

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

11. Apple App Store Provisions

If you downloaded Hiva from the Apple App Store, the following terms apply:

  • Acknowledgement: These Terms are between you and the Service Provider only, not Apple. Apple is not responsible for the App or its content.
  • Maintenance: Apple has no obligation to furnish any maintenance or support services with respect to the App.
  • Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Third-Party Beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes shall be subject to the jurisdiction of the courts in Andhra Pradesh, India.
